Supreme Court dismisses former GIIF CEO's bid to halt $2 million Sky Train trial

Asamoah, the first accused, had sought to quash the High Court’s decision to refuse his submission of no case and to restrain the High Court from continuing his trial. Justice Senyo Dzamefe, JSC, ruled that Asamoah's affidavit evidence did not disclose a serious case, and that the trial judge's decision was not made without or in excess of jurisdiction. The court also found that the applicant had not demonstrated irreparable harm if the injunction was not granted.

This ruling means trial proceedings can continue as scheduled. The High Court has set September 23 as the final deadline for the accused to file their defence. In a related development, the second accused, Prof Christopher Ameyaw Ekumfi, former Board Chair of GIIF, has filed a repeat application for a stay of proceedings, scheduled for September 1 at the Court of Appeal.

Both Asamoah and Ekumfi are on trial for allegedly paying $2 million for a Skytrain project without board approval.
