Federal judge blocks Trump's renewed attempt to limit birthright citizenship

US District Judge Deborah Boardman ruled that the administration cannot enforce the new, more limited policy, stating it is likely unconstitutional under a recent Supreme Court decision. Her order applies to a class of legal challengers, specifically children who would have been denied citizenship under the initial executive order. Attorney General Todd Blanche indicated that the administration anticipated this outcome and is prepared to appeal to the Supreme Court if necessary.

Trump's recent executive action, issued in August, aimed to deny citizenship to children whose parents are not citizens if either parent is an “alien enemy,” a “foreign government employee,” or involved in “birth tourism.” This follows a previous executive order from Trump's second term, which sought to deny citizenship to children of parents unlawfully in the country or on temporary status, an order the Supreme Court deemed unconstitutional earlier this summer.
