Senegal faces potential legal challenges over delayed territorial elections

The absence of a decree convening the electorate, the uninitiated revision of electoral lists, and the unfixed candidate deposit are fueling these worries. Electoral expert Ndiaga Sylla warns that a de facto postponement could lead to legal challenges before the Constitutional Council or the administrative court. The Front for the Defense of Democracy and the Republic FDR believes the authorities' inaction is deliberate, while the opposition party Pastef suggests most parties, except their own, are unprepared for the polls.

However, Aminata Touré, a leader in the presidential party Kiiraay, interprets Article 269, paragraph 3 of the Electoral Code, stating that elections can be held in the fifth year of municipal councilors' terms "if circumstances require it." She argues that this provision allows for flexibility and does not necessarily imply a report, as the election would still be within the legal framework. Kiiraay maintains readiness for elections at any time, in accordance with legal provisions.
