Western Cape High Court questions evidence of President Ramaphosa's alleged paid work in Phala Phala review

A key point of contention is whether Ramaphosa engaged in "paid work" in contravention of the Constitution. Advocate Kessler Perumalsamy, representing the African Transformation Movement ATM, argued that the foreign currency found at Ramaphosa’s farm links to his alleged paid work. Judges Mark Sher, Ncumisa Mayosi, and Western Cape Judge President Nolwazi Mabindla-Boqwana questioned the definition of "paid work" and the evidence presented.

Judge Sher asked for proof that the alleged transaction was personal and payment for work, noting that the transaction was reportedly between a lodge manager and Mr. Hazim, with no suggestion of the president's direct knowledge. Perumalsamy cited Ramaphosa's alleged instructions to his manager regarding the money and his statement at an ANC event, "I’m a farmer, I trade in animals," as evidence of his involvement. Judge Mabindla-Boqwana raised the argument of "good faith" in the president's interpretation of "paid work."

The court also discussed whether the independent panel exceeded its mandate and properly assessed Ramaphosa’s responses, particularly his compliance with the Executive Members Ethics Act and the code, and his divestment from interests to avoid conflicts.
