Human rights organizations sue Trump administration over ICC sanctions

The groups argue that these sanctions hinder victims of war crimes from obtaining justice. The complaint, filed in New York by four organizations including Human Rights Watch, asserts that the sanctions violate the First Amendment's protection of free speech and constitute an "illegal abuse of power." They contend that the restrictions severely compromise the ability to prosecute perpetrators of genocide, war crimes, and crimes against humanity.

The 101-page document describes the sanctions as a "frontal attack against the rule of law, the independence of judges, prosecutors and lawyers, the fundamental principles of the international legal order, as well as the principle of equal access to justice." The United States, which is not a party to the international treaty establishing the ICC, imposed sanctions that prohibit ICC judges from entering the country and block financial transactions with them. These measures are largely a response to ICC investigations into US ally Israel, including arrest warrants issued in 2024 against Israeli Prime Minister Benjamin Netanyahu.
